The purpose of the Spill Prevention, Control, and Countermeasure (SPCC) rule is to help facilities prevent a discharge of oil into navigable waters or adjoining shorelines. This rule is part of the U.S. Environmental Protection Agency’s oil spill prevention program and was published under the authority of Section 311(j)(1)(C) of the Federal Water Pollution Control Act (Clean Water Act) in 1974. Under this rule, certain facilities are required to evaluate the steps that have been taken to prevent the spill of oil or oil containing substances and the steps that will keep those products from being released to navigable waters of the United States

This regulation applies to facilities that have an aggregate aboveground oil storage capacity greater than 1,320 U.S. gallons or a completely buried storage capacity greater than 42,000 U.S. gallons and there is a reasonable expectation of an oil discharge into or upon navigable waters of the U.S. or adjoining shorelines.  (Generally, the second part of this test is easily met since any discharge could flow off sit on its own or be washed off as a part of a weather event and flow into the navigable waters of the United States.)  In determining whether the facility has exceeded the 1,320 gallon threshold, all containers with capacity of 55 gallons or more are counted.

Under this regulation, "oil" is not limited to petroleum oil or petroleum products.  Oil of any type and in any form is covered, including, but not limited to: petroleum; fuel oil; sludge; oil refuse; oil mixed with wastes other than dredged spoil; fats, oils or greases of animal, fish, or marine mammal origin; vegetable oils, including oil from seeds, nuts, fruits, or kernels; and other oils and greases, including synthetic oils and mineral oils.

Facilities that are covered by this regulation are required to take affirmative steps to prevent spills.  These steps can include the construction of a properly sized secondary containment area, the installation of equipment that will prevent overfilling containers, inspections to insure that the storage unit and all piping are compatible with the materials that are being stored and are in good condition.  The second part of this requirement is the preparation and implementation of an SPCC Plan.

The SPCC Plan describes oil handling operations, spill prevention practices, discharge or drainage controls, and the personnel, equipment and resources at the facility that are used to prevent oil spills from reaching navigable waters or adjoining shorelines. These plans must include operating procedures at the facility to prevent oil spills; control measures (such as secondary containment) installed to prevent oil spills from entering navigable waters or adjoining shorelines; and countermeasures to contain, cleanup, and mitigate the effects of an oil spill that has impacted navigable waters or adjoining shorelines. This plan must be certified by an independent registered professional engineer unless the owner meets the limited conditions that would allow them to self-certify.
