Some businesses are required to file a Form R by Section 313 of SARA Title III.  (This reporting is also sometimes called TRI or Toxic Release Inventory Reporting.)  This report seeks to track certain chemicals which are processed, manufactured, or otherwise used at the facility and determine how much of that chemical has been released to the environment.  This form will require the facility to disclose the  quantity of the chemical that is released to each medium of the environment, as well as how much of the chemical is recycled. The applicability of this reporting burden is dependant on several factors. 

First, the company must have an SIC code 10(except 1011, 1081, and 1094), 12 (except1241), 20-39, 4911 (limited to facilities that combust coal and/or oil for the purpose of generating electricity for distribution in commerce), 4931 (limited to facilities that combust coal and/or oil for the purpose of generating electricity for distribution in commerce), 4939 (limited to facilities that combust coal and/or oil for the purpose of generating electricity for distribution in commerce), 4953 (limited to facilities regulated under RCRA Subtitle C, 42 U.S.C. Section 6921 et seq.), 5169, 5171, and 7389 (limited to facilities primarily engaged in solvents recovery services on a contract or fee basis).

Second, the business must employ more then 10 people (or the equivalent of 20,000 employee hours per year).

Third, the facility must process, manufacture, or otherwise use more than the threshold quantity of one of the regulated chemical.

These chemicals are identified as a part of the Environmental Compliance Handbook which is prepared by ENCO Environmental for our client.  Along with the regulated chemicals, the products containing those chemicals are identified for easy tracking and determination of whether the facility has exceeded the threshold quantity of the regulated chemicals.
